【來自Socio-Legal Studies的啟發】
關於socio-legal research methods的課，今天的主題是feminist legal approach，大部分的時間課堂都圍繞在gender-based violence和gender discrimination的討論上，但我到半途的時候突然就神遊了，因為我就開始思考一個問題：Where do human rights come from?
為什麼腦海中會浮現這個問題，是因為當大家熱烈地討論著theoretically, law is perfect, but in reality, society is not.但是大家也激辯著when there is social awareness, an imperfect law should adapt to change.然後我就忍不住舉手發問了，到底：What kind of role of law can and should people expect, a guidance or a reflection of social change?
老師回答我both，舉了一些我在書上看過的例子，但似乎無濟於我真正想問的問題，於是我又問了：What if there had never been any ‘awareness’ of the marginalised and disadvantaged to bring up the issues, seek for remedies, or challenge the system, would the law or institution ever been changed? If not, then how do we justify that ‘equality’ is a natural and universal right?

【Homonationalim。Pinkwashing。Queer Nations】
From the news that Spain’s king – Felipe VI – got on the cover photo for a national gay magazine – RAGAP, I got a chance to learn more about a new trend in queer theory. At very first glance, I thought it is really fascinating that someone from a royal family shows his great support for gay rights. However, when I asked for opinions from Al who's from Spain, he provides a totally contrary view.
These days the right wing government has lost much confidence from people throughout the world, the new super trendy issue – LGBT rights – has been taken advantage of by highly politicizing.
Of course this rights movement is always politicized, but it changes now; it's now more than a battle between citizenry and the government; it's now an issue between parties in a country, countries in an international forum. It's a new name of waging nationalism, in light of a symbol of being progressive and democratic. Al commented on what Felipe VI has done that can be used as a mask to lessen all the scandals occurred in this family.

【Rainbow Politics。1st Debate On Marriage Equality】
Historically, will it be a breakthrough for Taiwan, a lighthouse for Others?!
After the local elections held in November, the society sort of saw a fuzzy beam of hope from a LGBTI-friendlier new politics in Taiwan. Next Monday (22/12/14) the rainbow factors in changing Taiwan are expected to reach another peak. Taiwan’s parliament (the Legislative Yuan) will first time substantially review the Marriage Equality Act (MEA) - legalisation of same-sex marriage out of the whole package of the draft ‘Diverse Formation of Family Union Law‘ which also includes civil partnership system and multiple-member family system but the latter two have never been placed onto the agenda.
After it is formally set up on the agenda for ages, MEA’s progress has been promoted better since the legislator Mei-Nu Yu was elected to chair the Judicial Commission of the parliament. She has always been regarded the most important contributor in the legislative forum, besides other supporters such as the legislator Li-Chiun Cheng. In fact, there have been more and more furious conflict between Taiwan Family Association (opposing to the same-sex marriage) and the Rainbow Coalition (mainly contributed by the Taiwan Alliance to Promote Civil Partnership Rights, Lobby Alliance for LGBT Human Rights Declaration, Intersex, Transgender and Transsexual People Care Association, Taiwan Gender Queer Rights Advocacy Alliance, and Appendectomy Project), when the MEA is step and step more becoming true.

Queer politics was never really visible and peaking in Taiwan until last year (September 2013) when the petition and great debate upon the so-called ‘Diverse Formation of Family Union Law‘ (including same-sex marriage, civil partnership system, and multiple-member family system) was incorporated into the Parliament’s agenda. This year, the political atmosphere has been even more intensified and heightened with the LGBTI rights movement.
People of diverse needs owing to different sexual orientation and gender identity are eagerly calling for an LGBTI-friendly government, despite the fact that not everyone, including the LGBTI rights advocates and activists, regard it as queering but probably ‘rainbowing’. For many of Taiwanese LGBTI, they do not seek to be distinct in identity but respected in equality, which is quite different from the Western itinerary and strategy in promoting LGBTI rights. Nevertheless, this is Taiwan’s ‘rainbow coalition‘ – encompassing all the civil rights movements, including not only the sexual minorities but also the persons with disabilities, migrants, labours, sex workers, and aboriginals.

As ‘black is beautiful’, ‘gay is great’ too.
In some cities, a Pride parade is a carnival. It’s a party demonstrating diversity of sexes, celebrating triumph of equality, and cheering acceptance from the societies.
But in many other places in the world, a Pride parade means more to the participants, when they are yet to be tolerated and embraced. The Pride risks being persecuted and blackmailed, and to somewhat extent, it can confront huge disapproval, by means of violence and humiliation.
In some cities, a Pride parade is a carnival. It’s a party demonstrating diversity of sexes, celebrating triumph of equality, and cheering acceptance from the societies.
