每經歷一輪模擬法庭的比賽
都會禁不住地想捫心自問
究竟如此汲汲營營地思索
為犯錯的國家或為惡人脫罪
操弄冠冕堂皇的司法藉口
鑽研煞有其事的法律漏洞
真實世界裡無法發現的真實
只因說服自己當事者無辜
是非對錯似乎沒有個定論
有時候會慶幸這只是個模擬
絕對不會希望發生的情境
難過的是現實中更加殘酷
究竟是a sophistry on criminal justice
或者真的是an argumentum of human dignity
其實連自己也不一定能夠清楚分辨
如同真實的人生裡那些抽象的觀念
越想釐清就越無法真的客觀去理解
2010年的ICRC IHL Moot Competition
我為被告的Surrebuttal寫了一段話
我們都視為破釜沈舟的final statement
強而有力且餘音繞樑卻非常虛幻:
At last but not the least,
the Defense table considers that
the Prosecution might feel difficult in
facts-finding and evidence-collecting.
However, the Defense table would also
like to humbly remind the Honorable Court,
in pursuit of the purpose of
international criminal law
along with this Special Trial,
the values of substantial justice,
international peace and genuine humanity
also requires sufficient basis
and reasonable grounds
to conclude Colonel Potter's
accountability for the alleged conducts.
By examining the relevant laws and customs
of armed conflict applicable to
any and every evidence to the facts,
the fundamental right to presumption of
innocence of the accused shall be assured.
Otherwise, the objects deliberately
encouraged by humanitarian law and the virtues
carefully provided by human rights law
would be arbitrarily undermined.
In consequence, the Defense table
firmly believes that all the accusations
of war crime against him shall be rejected
in compliance with corresponding
international standard for the non-derogable right
to a fair trial and the very criminal justice
anticipated by the international community.

水晶製的獎牌倒映出滿足的笑容
大家也都不再計較被告的生與死
彷彿一場模擬競賽就到此為止
只是自己卻忍不住地一直想著
如果今天真的發生了這樣的處境
身為律師的我是否真能冷靜看待
或是會打從心裡地支持檢察官
學習這麼龐大的一個法律體系
常常會感慨生也有涯而學也無涯
然後瞭解那麼多不容置喙的精神
又面臨了不得不辯的狡猾情狀
What if...there is a real "Atrocity against humanity"?
Will I still argue for "Assurance of Fairness"?
What if...there is a real "Aggression against Peace”?
Will I still insist on "Restoration of Security"?
What if...there is a real "Violation against Justice"?
Will I still make up "Lacuna of Justification"?
算了，先別想那麼多吧！
等到有一天，自己真的進了a real Court
真的接受了a real client的委託
這些dilemmas才會真的to be encountered吧～
